Terms of Service
These terms apply when you use this website, or when you buy and use a Delta product.
Last updated 28 October 2026
1. Who we are
This website and the Delta theme are supplied by SmallTownDev, of Ward no. 17, Ganeshpura, Ganj Basoda, Madhya Pradesh, India – 464221. In these terms, "we" and "us" mean that company. "You" means the person or the organisation that uses our website or our products.
2. Your agreement to these terms
You agree to these terms when you use this website, or when you install or use one of our products. If you do not agree, do not use them.
If you accept these terms for an organisation, you confirm that you have permission to do this.
3. Licence
Delta is dual licensed. The parts of the theme that hook into WordPress are released under the GNU General Public License, version 2 or later, and are marked as such in the source. The GPL gives you the right to use, change, and share that code, and nothing in these terms removes a right the GPL gives you. The rest of the theme is supplied under our commercial licence, and these terms govern it.
A purchase does not buy the code. It buys a licence key, and that key gives you:
- automatic updates for the period of your licence;
- access to support, as described in section 6.
There are two kinds of licence. A lifetime licence, sold during the launch period, never expires: updates and support are included for as long as we make Delta. A yearly licence, sold after the launch period, lasts one year and renews as described in section 4.
If a yearly licence expires, the software continues to work. You stop receiving updates and support until you renew.
4. Purchases and renewals
We use Freemius for licensing and payments. Freemius is the seller of record for every purchase: the contract of sale for the transaction is with Freemius, Freemius invoices you and handles the tax, and its terms apply alongside these. We supply the software and the support.
Prices are shown before you buy. A lifetime licence is paid once and does not renew. A yearly licence renews automatically at the price shown at the time of renewal, and Freemius emails you before it does. You can cancel a renewal at any time from your account, and cancelling stops the next payment rather than ending the current period.
5. Refunds
You can ask for a refund within 30 days of your purchase, for any reason. We refund the amount you paid, minus a small processing fee: the card or PayPal fee and the $0.50 Freemius fee, which are not returned on a refund. At current prices this is about $2 to $5 (4 to 6 percent of the price). Ask through the Support page or through your Freemius account. A refund ends the licence, and the licence key stops working.
6. Support
Support covers our products. It does not cover custom code, third-party plugins, server problems, or the content that an agent writes to your site.
Ask for support through the Support page.
7. Your site and your content
You own your site and everything on it. We do not.
Delta lets an agent write to your site: pages, templates, styles, and settings. You are responsible for what you tell an agent to do, and for the result. Keep backups. Check a change before you publish it. We are not responsible for content that an agent creates on your site.
8. Acceptable use
Do not use our website or our products to break the law, to attack other systems, or to send unwanted email. Do not try to get around a licence check, and do not resell a licence key as if it were your own.
9. Early-development software
Delta is in early development. Features can change, and some features are marked unstable in the product itself. Do not use an unstable feature on a site that you cannot afford to break.
10. Third-party services
Our products can connect to services that we do not control. These include payment and licensing through Freemius, WordPress plugins that an integration needs, and AI providers that you connect with your own API key. The terms of those services apply to your use of them. We are not responsible for them, and we do not control their prices or their availability.
11. No warranty
We supply the website and the products "as is". We do not promise that they are free of faults, or that they will meet your needs. This does not remove a right that you have as a consumer under the law that applies to you.
12. Limit of our liability
To the extent the law allows, our total liability to you for anything connected with our website or our products is limited to the amount you paid us in the twelve months before the claim.
We are not liable for indirect or consequential loss, for lost profit, lost revenue, or lost business, or for lost or damaged data or content, including content an agent writes to your site. Keep your own backups.
Nothing here limits liability that cannot be limited by law, and nothing here removes a right you have as a consumer under the law that applies to you.
13. Changes to these terms
We can change these terms. We will change the date at the top of this page. If a change is important, we will tell you before it starts to apply.
